Welcome to Guidonexo. These Terms and Conditions govern the use of our website guidonexo.com and the real estate crowdlending services we offer. By accessing or using our site, you agree to these terms in their entirety.
1. Definitions
"Platform" refers to the website guidonexo.com and all associated services. "User" refers to any person who accesses or uses the Platform. "Investor" refers to users who participate in crowdlending projects. "Project" refers to the real estate investment opportunities listed on the Platform.
2. Eligibility
To use our investment services, you must: be at least 18 years of age, be a legal resident in Chile or have the legal capacity to invest in the country, provide valid and verifiable identification information, and accept these Terms and Conditions in their entirety.
3. Services
Guidonexo operates a real estate crowdlending platform that connects investors with real estate development projects. We facilitate collective investment but do not guarantee specific returns. Each project has its own terms, risks, and conditions that must be reviewed before investing.
4. Investment Risks
Investing in real estate crowdlending involves significant risks, including the possible total loss of invested capital. Past returns do not guarantee future returns. We recommend diversifying your investments and not investing more than you can afford to lose. Guidonexo does not offer financial advice.
5. User Obligations
The user agrees to: provide accurate and up-to-date information, maintain the confidentiality of their access credentials, not use the platform for illegal or fraudulent activities, comply with all applicable laws and regulations, and immediately notify any unauthorized use of their account.
6. Intellectual Property
All content on the Platform, including texts, graphics, logos, images, and software, is the property of Guidonexo SpA or its licensors and is protected by Chilean intellectual property laws and international treaties. Copying, modifying, distributing, or commercially using such content without express authorization is not permitted.
7. Limitation of Liability
Guidonexo shall not be liable for: losses arising from investments made through the Platform, service interruptions or technical errors, acts of third parties or circumstances beyond our control, or indirect, incidental, or consequential damages. Our maximum liability is limited to the amount of fees paid by the user.
8. Applicable Law and Jurisdiction
These Terms are governed by the laws of the Republic of Chile. Any dispute shall be submitted to the exclusive jurisdiction of the ordinary courts of Santiago, Chile. The parties expressly waive any other jurisdiction that may correspond to them.
9. Modifications
Guidonexo reserves the right to modify these Terms at any time. Modifications will take effect upon being posted on the Platform. Continued use of the services after any modification constitutes acceptance of the new terms.
